AGB
1. Scope of Application
1.1. These General Terms and Conditions (“GTC”) apply to all services provided by ROC Ski & Snowboardschool, Gzsf/GmbH, Via Funivia 6c, IT03219510215, rocschool@pec.it, to consumers and businesses (collectively referred to as “Customers”). Deviating terms and conditions shall apply only if expressly confirmed by us in writing.
2. Services and Lesson Units
2.1. We offer group and private ski and snowboard lessons as well as other snow sports services in accordance with the respective service or course description.
2.2. One lesson unit lasts 55 minutes, unless expressly stated otherwise.
2.3. Lessons generally take place in all weather conditions, provided that they can be conducted safely and reasonably. Ski passes, equipment and meals are not included in the price, unless expressly stated otherwise.
3. Booking and Conclusion of Contract
3.1. Bookings can be made online, by e-mail, via WhatsApp Business, by telephone or in person.
3.2. The contract is concluded upon receipt of our written booking confirmation.
3.3. Payment: The full price of the booked service must be paid before the service begins, in particular by direct payment at our office, in cash, by card, via an online payment link or through other payment methods offered by us. An invoice will be issued upon request or where required by law.
4. Prices and Third-Party Services
4.1. All prices are stated in euros (EUR) and include all legally applicable taxes.
4.2. Services provided by third parties, in particular lift operators, rental companies, transport companies or other external service providers, do not form part of our contract, unless expressly stated otherwise.
5. Participation Requirements and Safety
5.1. Customers must be physically and medically fit to participate in the booked service. Information regarding skiing ability, experience and any other circumstances relevant to the safe provision of the service must be provided truthfully.
5.2. Legal requirements on Italian ski slopes:
5.2.1. A valid third-party liability insurance covering damage or injury caused to third parties is legally required for the use of ski slopes. The Customer is personally responsible for ensuring that appropriate and valid insurance coverage is in place.
5.2.2. When alpine skiing and snowboarding, an appropriate and approved protective helmet must be worn in accordance with the applicable legal requirements.
5.2.3. Skiing and snowboarding under the influence of alcohol, drugs or other intoxicating substances is prohibited. Violations may result in legal penalties and further measures by the competent authorities.
5.2.4. We also expressly recommend taking out private accident insurance.
5.3. The instructions of the instructors must be followed. The applicable FIS rules as well as all other statutory, regulatory and ski-area-specific safety and conduct rules must be observed.
5.4. Minors
5.4.1. For participants who are minors, parents or legal guardians are required to provide correct information at the time of booking, in particular regarding the participant’s age and actual skiing ability, and to inform the ski school of all information necessary for safe participation in the lessons.
5.4.2. An emergency contact person who can be reached during lesson times must be provided for participants who are minors.
5.4.3. Unless expressly agreed otherwise, minor participants must be handed over punctually to the responsible instructor at the agreed meeting point at the beginning of the lesson and collected there again at the end of the lesson. Parents or legal guardians are responsible for punctual collection.
The ski school’s duty of supervision begins when the minor is actually handed over to the instructor and generally ends when the minor is returned as agreed to the parents, legal guardians or a previously designated person authorised to collect the minor.
6. Equipment and Ski Pass
6.1. The Customer is responsible for ensuring that their equipment is suitable, functional and properly maintained, in particular that the ski bindings are professionally adjusted.
6.2. Any required ski passes must be purchased independently and at the Customer’s own expense. Lessons cannot take place on slopes requiring a ski pass without a valid ski pass.
7. Cancellation, Changes and No-Shows
7.1. Cancellations must be made in writing by e-mail to info@roc-school.com, stating the relevant booking.
7.2. Cancellation more than 48 hours before the start: If a cancellation is made more than 48 hours before the agreed start time, the amount already paid will be refunded. Only an administration fee of €20.00 per booking will be retained.
7.3. Cancellation within 48 hours: If a cancellation is made within 48 hours before the agreed start time, 50% of the total price of the booked service will be charged or retained.
7.4. No-Show: If the Customer fails to appear at the agreed meeting point without prior cancellation, 100% of the total price of the booked service shall be payable. This also applies if the service can no longer reasonably be provided due to a significant delay on the part of the Customer.
7.5. Late arrival: If the Customer arrives late, the lesson will not start correspondingly later but will end at the originally agreed time. A delay caused by the Customer does not entitle the Customer to an extension, replacement lesson or refund for the missed lesson time. If, however, a significant delay is attributable to the ski school, the missed lesson time will, where possible, be made up or refunded proportionately.
7.6. Illness or injury: Notwithstanding the cancellation conditions set out above, in the event of illness or injury, upon presentation of appropriate medical documentation, a proportionate refund may be granted for services not used from that point onwards. Services already used will not be refunded. The medical documentation only needs to confirm that participation in ski or snowboard lessons during the relevant period is not possible for health reasons. A diagnosis or the transmission of detailed medical information is not required and should not be provided.
Alternatively, subject to agreement and availability, the booking may be rescheduled.
7.7. Weather conditions, operational restrictions and force majeure: Lessons generally take place even in unfavourable weather and snow conditions, provided that they can be conducted safely and reasonably.
If the Customer decides not to participate for personal reasons even though the ski school can properly provide the booked service or a reasonable equivalent service, there is no entitlement to a refund outside the regular cancellation conditions.
If, however, a service has to be cancelled by the ski school or cannot be provided due to safety reasons, official orders, the complete or materially relevant suspension of lift operations, exceptional weather events, acute avalanche danger or other circumstances beyond the control of the contracting parties, services already paid for but not provided will be refunded proportionately.
If only part of the booked service cannot be provided, the portion not provided will be refunded proportionately.
Instead of a refund, the ski school and the Customer may mutually agree to reschedule the booking or issue a credit. The Customer’s mandatory statutory rights remain unaffected.
7.8. Taking out appropriate travel and/or cancellation insurance is expressly recommended.
8. Minimum Number of Participants and Course Organisation
8.1. If the required minimum number of participants for a group course is not reached, we reserve the right to combine groups, adjust lesson times within reasonable limits or offer an alternative service or private lessons. If an offered alternative results in additional costs, these will only be charged with the Customer’s prior consent. If no appropriate alternative service can be offered, services already paid for but not provided will be refunded accordingly.
8.2. We reserve the right to make organisationally necessary changes to the programme, meeting point, group allocation or lesson organisation, provided that the essential nature of the booked service is maintained. Price changes shall have no retroactive effect on bookings that have already been confirmed.
8.3. Change of instructor: The ski school reserves the right to replace the originally scheduled instructor for organisational, operational or personal reasons, in particular due to illness, injury or short-term unavailability, with an appropriately qualified instructor.
An entitlement to lessons with a particular instructor exists only if this was expressly confirmed as an essential part of the booking at the time of booking.
A change of instructor alone does not entitle the Customer to cancellation, a price reduction or a refund, provided that the booked service is delivered in a comparable manner.
9. Liability
9.1. The ski school shall be liable, within the scope of mandatory statutory provisions, for intent and gross negligence as well as for damage to life, physical integrity or health.
9.2. In all other respects, liability for slight negligence shall, to the extent permitted by law, be limited to foreseeable damages typical of the contract. Mandatory statutory consumer rights remain unaffected.
9.3. Personal responsibility: Participation in snow sports involves risks inherent to the sport. Customers must comply with the applicable safety regulations and are responsible for ensuring that they have the legally required third-party liability insurance. Taking out private accident insurance is recommended.
9.4. The ski school accepts no responsibility for services, failures or operational interruptions of third parties, in particular lift operators, rental companies or transport companies, insofar as such circumstances are not attributable to the ski school’s area of responsibility. The Customer’s statutory rights remain unaffected.
10. Ski School Insurance
10.1. The ski school maintains business liability insurance to the extent required by law and in accordance with the applicable provisions and requirements of the Autonomous Province of Bolzano. Further information is available upon request.
11. Right of Withdrawal for Online Bookings
11.1. For services related to leisure activities booked for a specific date or period – in particular ski courses, snowboard courses and private lessons – there is generally no statutory 14-day right of withdrawal for online bookings under the applicable legal provisions.
The contractual cancellation options pursuant to Section 7 remain unaffected.
For other services for which a statutory right of withdrawal exists, the respective applicable legal provisions shall apply.
12. Photo and Video Recordings
12.1. Photographs and video recordings of Customers for advertising, marketing or social media purposes will only be taken and/or published with the appropriate consent of the person concerned. In the case of minors, the required consent of the parents or legal guardians must be obtained.
12.2. Consent that has been granted may be withdrawn at any time with effect for the future. The lawfulness of processing carried out on the basis of consent before its withdrawal remains unaffected.
13. Data Protection (GDPR)
13.1. The controller responsible for processing personal data is the operating company of ROC Ski & Snowboardschool specified in Section 1.1.
13.2. Personal data is processed in particular for the performance and administration of the contractual relationship, compliance with legal obligations and, where applicable, on the basis of legitimate interests relating to operational organisation and safety. Photography and marketing activities are carried out, where required, on the basis of appropriate consent.
13.3. Further information about the data processed, recipients, retention periods, the rights of data subjects and the right to lodge a complaint with the competent data protection supervisory authority can be found in our Privacy Policy.
13.4. Medical documentation: Medical documentation submitted in connection with a cancellation, refund or rescheduling due to illness or injury will be reviewed exclusively for the purpose of assessing the relevant claim.
The medical documentation and any health data contained therein will be deleted or destroyed immediately after review and verification and will not be stored permanently.
For administrative, accounting and contractual purposes, it may only be documented that appropriate evidence was reviewed and which refund or rescheduling resulted from it. Diagnoses or other detailed medical information will not be stored.
14. Complaints
14.1. Complaints may be submitted in writing to info@roc-school.com. We endeavour to process complaints promptly and appropriately.
15. Applicable Law and Jurisdiction
15.1. Italian law shall apply, excluding conflict-of-law rules, insofar as mandatory statutory provisions, in particular those protecting consumers, do not provide otherwise.
For consumers, the mandatory statutory rules regarding jurisdiction shall apply.
For contracts with businesses, Bolzano shall be agreed as the exclusive place of jurisdiction to the extent permitted by law.
16. Severability Clause
16.1. Should any provision of these GTC be or become wholly or partially invalid, void or unenforceable, the validity of the remaining provisions shall remain unaffected. The relevant applicable statutory provisions shall replace the provision concerned.
17. Amendments to these GTC
17.1. We reserve the right to amend these GTC with effect for future bookings. The version published or agreed at the time the contract is concluded shall apply to each booking.
18. Language Versions
18.1. These General Terms and Conditions are available in German, Italian and English. The different language versions are intended to correspond in content and shall be interpreted equivalently.
Should any discrepancies or ambiguities nevertheless arise as a result of translation, the provisions shall be interpreted taking into account the purpose of the contract and the applicable legal provisions. Mandatory statutory consumer rights shall remain unaffected in all cases.
